Consistent efforts of SNEA (India) resulted in this notification and change of scheme into OMR system even though some groups tried their best to stop the LDCE as last time. Holding of examination for the post of DGM on 11.10.2009 has been deferred till further notice.

Hon. High Court of Andhra Pradesh is reported to have stayed the DGM rect in W.P. 21523/2009. The case will be heard after two weeks.

Allahabad CAT is reported to have stayed the holding of Examination for DGM Direct Recruitment, notified to be held on 11.10.2009. As per  the  operative portion of the order that says,"We are of the view, prima facie, that 'direct recruitment' is not warranted under Recruitment Rules and Respondent should not be allowed to create uncertainty for the Applicants and/or third party (i.e. person who may be selected in future for Direct Recruitment). In the totality of the circumstances we are satisfied that the applicants are entitled to interim relief prayed for."

BSNL Tie up with Tata Tele Services &  Aircel : BSNL is  reported  to  has entered an agreement with TATA Teleservices  &  Aircel  For sharing of infrastructure, according to which BSNL GSM towers in almost  all  the  Telecom Circles will be shared with Tata Tele Services  &  Aircel . Two agreements of passive infrastructure sharing were signed by BSNL in 2 days. Private operators are now eyeing for rural operations and in rural GSM infrastructure BSNL’s reach is unmatched. BSNL is going to get Thousands of Crores of rupees yearly from these two deals. But we  must  admit that by  doing  so  that  too  with our  competitors we may loose somewhere. Lets see !

Comrades, get immediately ready for an All India Programme of most militant form of sustained organizational action to defeat the sinister designs of BSNL management and bureaucracy of DoT to inflict irreparable and irreversible damage on BSNL by calling for volunteers from Indian P & T Accounts and Finance officers (Class I services) to be sent on deemed deputation to BSNL/MTNL.

We are at a loss to understand how this letter calling for volunteers from DoT on deemed deputation to BSNL/MTNL has been issued by DoT when the Union Cabinet has repeatedly taken a conscious and clear decision not to allow anyone from DoT to BSNL/MTNL on deemed deputation.

This conspiracy between vested interests in the bureaucracy of DoT and BSNL management  has not only to be exposed but defeated lock, stock and barrel.

What we fail to understand is how a very senior officer of BSNL management from Finance wing had requisitioned for sending some officers from Indian P & T Accounts and Finance to BSNL on deemed deputation. But the most pertinent question that arises is how this decision of  Ex- Dir (F), BSNL was concurred to by CMD, BSNL and how the proposal was finally approved by Member (F) , DOT and Secretary, DoT in complete contravention of the decision of the Union Cabinet turning down the proposal of deemed deputation of anyone from DoT to BSNL/MTNL.

Get ready for a do or die agitation to defeat the conspiracy of vested interests to inflict irreparable damage on  BSNL  by allowing deemed deputation of class I officers from DOT to BSNL.

 Meeting with Director(HRD):  

The Association was called for a discussion on the issue of revisiting 30% fixation granted on the new IDA scales in accordance to the orders of DPE. GS and AGS, Com. A. Khan, expressed opinion on the said issue in very clear and unambiguous terms. Under no circumstances and in no situation can this Association even remotely reconcile to the suggestion of BSNL Management for reconsideration of the fixation criterion already decided and implemented. Any step in the direction of reducing the existing fixation on IDA scales will result in instantaneous industrial unrest of the worst kind, we categorically apprised Director(HRD), and requested him to convey the opinion of our Association to BSNL Board on the same lines. Legitimate fixation of pay in conformity with the orders of the govt. cannot be fiddled with by BSNL/Board and any attempt in the direction of diluting the fixation already decided will be met with stiffest resistance from our Association. Such arbitrary and authoritarian moves of the Management shall be squarely defeated by us, we are completely confident, for the simple reason that such decisions are not only indiscreet but a clear infringement on our legitimate rights and violative of the decisions of the govt. We further requested Director(HRD) not to act in a manner that will adversely and irreversibly affect the ongoing developmental activities in the organization.

2 Lakh employees of BSNL will be transferred; New PSU to be created from BSNL; will be called NOFA: DOT has finalized the proposal for creating new PSU the National Optic Fibre Authority(NOFA) and about two third of BSNLs employees would be would be shifted to new PSU, News report says BSNL has at present about 3 Lakh employees and about 2 lakh will be transferred to new PSU. New PSU have the mandate to lay the optic fibre across the country and then lease that network to telecom firms for providing Broadband services. The Government would setup the authority to lay over 12 lakh Kms of optic fibre through out the country spending around Rs 40,000 Crores, the mix and match will be perfect as BSNL needs to shed staff while the newly created PSU would need people. Wage bill of BSNL is over Rs 10,000 Crores and may increase by another 2500 crores this year and wage to turnover ratio is 28%.

As per SNEACHQ  news our Legal Council has advised that all the executives, regardless of  restrictions imposed in terms of age and qualification contained in the provisions of recently notified MT RRs, should submit the application for appearing in the internal Competatative examination for recruitment of (250) MTs. United Forum of BSNL Executives' Association writes to CMD, BSNL for the modification of provisions of MT RR notified on 01.09.2009 which are discriminatory and against natural justice. UF clearly told the Management that the notification not only discriminates and denies the really meritorious, but is also violative of the DOP & Trg guidelines and various Supreme Court Judgments as it will lead to the creation of "a class with in a class". UF demanded the internal fast track promotion is to be carried out without discriminations of qualifications and age, otherwise we will be unwillingly constrained to resort to all actions including agitational and legal actions to ensure justice prevails.

Sept 2009Meeting with DIR(HRD), BSNL:                     GS, AGS Com. K. Sebastin and Jt Sec (North) Com. Inderjith Singh met DIR(HRD) and discussed the MT R/R and the proposed MT recruitment. GM(Pers) also present. We clearly told the Management that the age and educational qualification mentioned in the MT R/R for internal candidates is in clear violation of orders of DoP&Trg, regulating the provisions of the internal competitive examination. 3000 to 4000 Engineering Graduates from premier institutions such as Regional Engineering Colleges (NITs) and Govt. Engg colleges (some of them having M Tech) recruited by DoT in the year 1994 and prior to that and having minimum 12 years of experience in Telecom operations are not allowed to compete in the internal competitive examination. In addition to this, thousands of Post Graduates and Graduates with minimum first class (even some of them are University rank holders) and having vast experience in Telecom operations also deprived the opportunity. Some of them having MBA/MCA degree also. Some JTOs quit their job and joined BSNL in 2001 year rect. also not eligible because of the age limit. GM(Pers) informed that already relaxation of 6 years is given to the internal candidates as 5 years relaxation given by UPSC. We clearly told that this relaxation of 6 years is for External quota and not for Internal quota. For Intl quota, there should not be any age or qualification bar. If the Management  not considering this, we fear that the entire rect process may face legal hurdle and the recruitment will be delayed for years together. Further we told that we will submit a comprehensive note on Monday and management has to reconsider the eligibility conditions of Intl candidates based on that. We will further discuss the matter with CMD/DIR(HRD), BSNL next week.

 11.09.2009 RECRUITMENT OF MANAGEMENT TRAINEES:

Association is all along pleading with the Management that there should not be any AGE / QUALIFICATION BAR for the rect. of Management Trainees through internal competitive examination. Association elaborately submitted its views to the committee constituted under the chairmanship of PGM (IR) to examine the issue of relaxation in age and qualification for MT rect through internal competitive examination. Association strongly pleaded for allowing BSc, 1st class (Educational qualification for Outside rect of JTOs), with no age bar, to appear for the internal competitive examination.   The management has ignored the views of the Association in contravention of the orders of DoP&Trg, regulating the provisions of the internal competitive examination. Association is determined to end this discrimination and going to take up the issue with the Management once again. Managements failure to respond to our plea of conduction of internal competitive examination in accordance to DoP&Trg rules allowing Executives to appear in the internal competitive examination with no age bar and Educational qualifications of BSc (First Class), shall force the Association to seek appropriate legal recourse. 

10th Sept 2009 MT RECRUITMENT: MOST OF THE TALENTED AND EXPERIENCED EXECUTIVES IN BSNL ARE DELIBERATELY BARRED IN THE NAME OF AGE & QUALIFICATION AS DONE IN THE CASE OF DGM RECT. ASSOCIATION IS ALL ALONG PLEADING WITH THE MANAGEMENT THAT AS PER DoP&T GUIDELINES THERE SHOULD NOT BE ANY AGE / QUALIFICATION BAR FOR THE INTERNAL CANDIDATES. WE ARE STRONGLY TAKING UP THE WHOLE ISSUE WITH CMD/DIR(HRD), BSNL. ASSOCIATION WILL TAKE ALL STEPS INCLUDING ORGANISATIONAL AND LEGAL ACTION FOR SETTLING THIS ISSUE.

Revised MT RR: Salient features:

1.       Pay Scale : E3 scale: Rs. 24,900 – 50,500/-

2.      No of posts: MTs shall be recruited against 50% of equivalent STS level posts as decided by BSNL Management for each year. Initial strength shall be 600. (MT- Operations – 500, MT – Accts & Finance – 100)

3.      Ratio of posts: 50% of posts will be open for both Extl and Intl candidates and will be filled based on merit. Remaining 50% posts will be reserved for Intl candidates only.

4.      Mode of recruitment: The selection shall be based on the final merit list created based on the combined score from assessment process (75%)  + Group discussion (12.5%) + Personnel interview (12.5%). 50% of MT posts shall be filled regardless of Extl or Intl candidates. Remaining 50% of MT posts will be reserved for Intl candidates.

5.      Recruitment year: Rect. Year shall be the year of declaration of result.

6.      Probation – cum – training: 52 weeks including the job on training.

7.      Career progression: Appointment as Manager (MT) [Sr. SDE grade, E3 scale] on successful probation cum training. To be promoted as Asst. General Manager (E4 scale) on 2 years working as Manager (MT). Further promotion will be as per BSNL MS R/R, 2009.

8.      Age limit. MT(Extl) – 30 years, MT (Intl) – 36 years as on 01st August of the year of Examination. (Relaxable  in the case of reserved category as per Govt. rules)

9.      Eligibility for Intl candidates: Regular BSNL employee at or above JTO/JAO equivalent level and below MT level with 4 years experience in BSNL and possessing the required eligibility conditions.

Payment of PLI for 2008-09: DIR(HRD) called the two recognized Executive's Associations in BSNL, SNEA(I) and AIBSNLEA to discuss payment of PLI for the year 2008-09. Management told that this year employees may agree for not to take Bonus as the Financial position is bad. Even if PLI has to be paid, as per DPE guidelines 5% of the distributable profit can be paid (ie. 5% of Rs. 575 crores which comes to Rs. 28 crore). ie. Rs. 28 crores can be distributed among 55,000 Executives and the amount comes to Rs. 5000 which is 50% of last years minimum PLI.

Consumer court has no jurisdiction over telecom disputes with consumers. --- The Supreme Court on Tuesday ended the jurisdiction of consumer courts to entertain disputes relating to telecom services. It said from now on, these disputes would be resolved through arbitration provided under Section 7B of the Indian Telegraph Act, 1885.<<News>>

On 11th August 2009 GS along with GS AIBSNLEA met Dir(HRD) and discussed the issue of regularization of adhoc STS officers. They also emphasized about relaxing the eligibility condition in DGM recruitment such that the incumbent executives of BSNL should also become eligible to write the examination of DGM recruitment.

 
Last date for receiving of the application form for DGM, recruitment has been extended upto 24.8.09.

 BSNL profit for 2008-09 falls to Rs 575 Crores from Rs 7806 Crores in 2006-07: Unbelievable  Downfall  -  Time  to  alert  ourselves  for  the  consquences .
Minister of State for telecom & IT Sachin Pilot has informed  Rajya Sabha that:

Bharat Sanchar Nigam Limited's (BSNL) revenue arrears for 2007-08 have touched Rs 7,482.81 crore, out of which Rs 4,226 crore may or may not materialize, Rajya Sabha was informed in last week. The biggest defaulters are private customers under basic services who owed Rs 4,173.63 crore as on March 31, 2008.

Replying to a query, he said the government is considering a proposal of charging a one-time entry fee for spectrum allocation beyond 6.2 MHz of spectrum.

He said TRAI is seeking penalty powers on telephone companies for violating its directives.

"TRAI has sent a consolidated revised proposal to DoT to consider various amendments in the TRAI Act 1997, which provides for imposition of penalty on telephone operators for violation of its directions," Minister said.

The government has collected Rs 26,207.11 crore as Universal Service Levy as on June 30, 2009, since the inception of Universal Service Obligation Fund in April 2002.Out of this Rs 6,948.64 crore have been reimbursed to BSNL for the payment of license fee and spectrum charges to DoT, Pilot said.

Pilot said the net profit of BSNL has fallen sharply from Rs 7,806 crore in 2006-07 to Rs 575 crore in 2008-09 due to surrender of fixed telephones, decreased tariffs and wage costs.

BSNL, which has started 3G services in selected cities has 10,733 subscribers for the service, while MTNL had 902 subscribers for 3G services as on June 2009.

BSNL has planned a capex of Rs 2,700 crore for the first phase of 3G rollout and proposes to provide 3G services in 760 cities in the first phase covering district headquarters, commercially important towns and tourist places. The work will be completed by 2010-11.

MTNL plans to spend Rs 300 crore for offering 3G services in Delhi and Mumbai and is adding 7.5 lakh lines each in Delhi and Mumbai.

BSNL's  3G  response  is  very  poor.

BSNLs profit erosion rings alarm bells: 97% erosion in net profit in two years (Profit after Tax fell sharply to Rs 104 crores in 2008-09 from Rs. 3009 crores in 2007-08)--- Hon. MOC meets senior officers today.  <<News>> 

It is reliably understood that latest figure of BSNL's profit for 2008-09 is Rs. 576 Crores instead of Rs.104 crores. However the erosion in the net profit is alarming especially in landline sector. We are pursuing with the Management to post more Executives in the revenue generating areas such as field units, sales &marketing etc instead of offices. Focus has to be given to rural areas where more potential is there.

BIHAR TELECOM CIRCLE, PATNA  has  launched  the  marketing  of  BSNL  Products  through  its  new  marketing –cum-sale  programme:

 

       SNEA BIHAR has  Started  the  Exhibition-cum-Sale of BSNL’s products, New Services such as New Telephone Connections, Broadband Connections, Pre-paid WLL, EVDO, 2G mobile connections, 3G Mobile connections, 3G Data Cards, Blackberry Services etc. at   MAURYA LOK  COMPLEX ,PATNA   &  other important places in Patna (As Pilot Scheme) such as all Colleges and Institute of Patna University & Magadh University, Patna Railway Station, Patna Airport, All important State/Central/PSU establishment campus and important business center at Patna with manpower and expenditure at the cost of the Association.

                  

In this regards  CGMT Bihar Circle  has specially arranged for providing Marketing materials such as forms for new connections Broadband, Landline, Mobile (2G+3G), EVDO, Pre-paid WLL etc, advertisement &  tariff details in printed form. Products of BSNL to be sold have  also been provided with appropriate selling terms and conditions on “ No Profit-No Loss” formula.The  association will manage need of manpower voluntarily and other infrastructure and expenditure ourselves on behalf of SNEA (I) Bihar Telecom Circle.

 

Our  CGMT ,Bihar  Circle  has  personally  visited  the  stall  at  Mourya  Lok  Complex  &  appreciated  our  approach  with  a  promise  to  provide  all  type  of  support  . This is our first step towards our role and responsibly of making BSNL a viable and vibrant organization in Public Sector. Very soon we shall take our next step towards enhancement of Quality of Services.

Brief of RRs. 

1.    Rules will be called as BSNL Management Services or ‘BSNLMS and will be effective from 11th July 2009.  

  1. Mode of Recruitment: The mode of recruitment shall be either by examination or interview or examination & interview or Campus Selection.

      3.   Method of Recruitment, Field of Promotion & Minimum qualifying service –

         In the lower grade for appointment of EXECUTIVES on promotion to DE/CAO/AGM

       a) From directly recruited MTs, to the extent of vacancies to be decided by the BSNL Management every year, subject to 50% of the posts.

      (b) 50% of posts by promotion from SDE/AO or equivalent level executives by selection cum seniority from regular SDE/AO or equivalent grade of the concerned stream who are Engineering graduates/graduates with total qualifying service of 7 years. Educational qualification for executives to be promoted to the grade of DE/AGM/CAO shall be engineering degree or equivalent in Telecommunications, Electronics & Computers / IT/ Electrical for Telecom Operations & graduate or equivalent in respect for Finance of BSNLMS. However, existing incumbents, regardless of educational qualifications, holding the posts of Executives on regular basis on the date of notification of these RRs shall continue to be eligible for promotion to the grade of DE/AGM/CAO.

6. All Gr. A officers of various services recruited by DoT and absorbed as Gr.A will rank en block senior.

7.  Promotion to JAG will be done from amongst the executives at STS level on regular basis from a seniority list of MTs & promoted STS executives in the ratio of 1:1.

8. On promotion fitment will be done under FR 22(1) (a) (1) or as per the company rules from time to time.

9. The number of management trainees to be recruited will be decided by the BSNL Management each year.

10. Promotion to JAG and above will be based on ‘selection by merit’. For promotions to STS, JAG, Jt GM, Add GM, GM, Sr GM, qualifying service shall  be 7, 4, 5, 4, 5 & 8 years  in one rank below.

11. Existing regular TES Gr B or equivalent, regardless of educational qualifications, on the date of notification of RRs, shall be eligible for promotion to the grade of STS.

12. The posts of STS (other than 50%) remaining unfilled can be filled up by promoting eligible Gr.B (SDE and equivalent) officers on adhoc basis if deemed necessary by the Management.

13. After promulgation of BSNLMS RRs, group B executives shall be promoted to/regularized in STS, depending upon the vacancies of their respective quota, as per the provisions of RRs. Those working in STS on adhoc basis shall, after their regular promotion as STS, be given adhoc promotion to JAG, depending upon JAG vacancies. While making adhoc promotion to JAG for the first time after the notification of these RRs, relaxation in the Eligibility service will be considered as a one time measure subject to the approval of the Management Committee.

New  30.06.2009 Successful  Completion  of  CWC meet at Shillong Held on 26th & 27th June 09:  Report: : The two day Historic and Glorious Central Working Committee meeting of SNEA(I) was  successfully held on 26th & 27th June 2009 at Hotel Orchid, of Shillong the capital city of Meghalya, This CWC was unique and historic in the way that for the first time development of BSNL agenda was  discussed  in place  of  conventional HR related Agenda. Right from the 25 page brief Report and address of GS to the report of each and every Circle Secretary  submitted their  views, opinions, suggestions and concern over the falling market share of BSNL, continuous declining  trend in revenue, Poor response to new 3 G and Blackberry services and  Falling Profits of Company were mainly discussed in two days discussions.Bihar CWC team was led by CS Com. Ratish Kumar ,Com Madhusudan Mahto,Com Abhay Kumar and Com D.K.Verma.

Supreme Court verdict on 12.05.2008 in Civil Appeal No. 7631 of 2002. All the APAR entries has to be communicated to the official for fairness and transparency in administration.
